The owner of the online store endawo.dk, endawo.com, endawo.ee, endawo.se, endawo.nl, endawo.de, endawo.fi (hereinafter referred to as the Online Store) is FCD OÜ (registration code 14892278), located at Valuoja pst 17-26, 71013 Viljandi, Viljandi County, Estonia.
Validity of the Sales Agreement, Product, and Price Information
The terms and conditions apply to purchases made in the Online Store.
The prices of the products sold in the Online Store are indicated next to the products. The price is subject to an additional fee for delivery.
The delivery fee depends on the buyer’s location and the delivery method chosen. The delivery fee is displayed to the buyer during the order process.
Information about the products is provided directly next to the product in the Online Store.
Placing an Order
To order a product, the desired items must be added to the shopping cart. To complete the order, the required data fields must be filled in, and a suitable delivery method must be chosen. The total amount payable will then be displayed on the screen, which can be paid via bank link or other payment solutions.
The agreement enters into force from the moment the total payable amount has been received in the Online Store’s bank account.
If it is not possible to deliver the ordered product due to stock depletion or other reasons, the buyer will be informed as soon as possible, and the amount paid (including delivery costs) will be refunded within 1-2 business days. Depending on the payment method, the refund may take up to 7 business days.
Delivery
The cost of shipping is borne by the buyer, and the corresponding price information is displayed next to the delivery method.
Domestic shipments within Estonia generally reach the designated destination within 3-7 business days from the entry into force of the sales agreement. Deliveries outside Estonia are completed within 15 calendar days.
In exceptional cases, the Online Store has the right to deliver the goods within up to 30 calendar days.
If the Online Store has informed the buyer via the website or order confirmation of any delivery issues and an extended delivery time exceeding 30 calendar days, the Online Store’s stated delivery time shall apply.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.
To exercise the 14-day return right, the ordered goods may only be used to the extent necessary to verify their nature, characteristics, and functionality, as would be allowed in a physical store.
If the goods have been used for any other purpose than necessary for verification, or if they show signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.
To return the goods, a withdrawal statement must be submitted, which can be found here: withdrawal form, and sent via email to info@endawo.com within 14 days of receiving the goods.
The cost of returning the goods is borne by the buyer unless the reason for the return is that the goods do not correspond to the order (e.g., incorrect or defective item).
The buyer must return the goods within 14 days of submitting the withdrawal statement or provide proof that the goods have been handed over to a carrier within that period.
Upon receiving the returned goods, the Online Store will refund the buyer immediately but no later than 14 days after receiving the withdrawal statement, all amounts received under the sales agreement.
The Online Store may withhold the refund until the returned item has been received or until the buyer has provided proof that the item has been returned, whichever occurs first.
If the buyer has explicitly chosen a delivery method that differs from the Online Store’s standard least expensive delivery method, the Online Store is not required to refund any costs exceeding the standard delivery cost.
The Online Store has the right to withdraw from the sales transaction and reclaim the goods if the price of the goods was mistakenly marked significantly below the market price.
Right to File a Complaint
The Online Store is responsible for any non-conformity or defects in the goods sold to the buyer that existed at the time of delivery and that become apparent within two years from the date of delivery to the buyer. For the first year from delivery, it is presumed that the defect existed at the time of delivery. It is the responsibility of the Online Store to rebut this presumption.
If defects appear, the buyer has the right to notify the Online Store within two months by sending an email to info@endawo.com.
The Online Store is not liable for defects arising after the goods have been handed over to the buyer due to improper use, an accident, or normal wear and tear.
If a defect is found in a product purchased from the Online Store, the Online Store will repair or replace the defective product. If the product cannot be repaired or replaced, the Online Store will refund all charges incurred under the sales agreement.
The Online Store will respond to the consumer’s complaint in writing or in a format that allows for written reproduction within 15 days.
Dispute Resolution
If the buyer has complaints about the Online Store, they should be sent via email to info@endawo.com.
If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. The terms of the procedure can be found and an application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from contracts concluded between the buyer and the Online Store. The review of a buyer’s complaint by the Committee is free of charge.
The buyer may also refer to the European Union’s Online Dispute Resolution (ODR) platform.
